2. Following relief(s) have been prayed for in paragraph no. 1 of the present writ application. "1. That this is an application for issuance an appropriate writ/writs, order/orders, direction/directions in the nature of Mandamus Commanding and directing upon the respondent authority to make payment of Compensation against the

Patna High Court CWJC No.13327 of 2016 dt.26-09-2024 2/3 under acquired by the Land Acquisition Officer, Patna for the purpose of Patna Buxar N.H. for the purpose of developments and Construction of National High Way 30 & 84 (Patna Buxar) Road by which the plot no.-382 & 383, Thana no.95, MauzaHasanpura has been acquired by the Authority without serve any Notice and without any payment of the Compensation amount."

3. At the outset, learned counsel for the petitioner has confined his prayer only to the extent of disposal of representation dated 16.10.2015 (Annexure-1) which is pending consideration before Respondent No.3 within a time frame.

Learned counsel for the State raised no objection to the prayer made by the learned counsel for the petitioner for disposal of representation dated 16.10.2015 but learned counsel prayed that the petitioner may be directed to file fresh representation before Respondent No. 3 in case if the aforesaid representation dated 16.10.2015 has been disposed of till now.

5. Considering the aforesaid facts and circumstances, the petitioner is directed to file fresh representation, in case the

Patna High Court CWJC No.13327 of 2016 dt.26-09-2024 3/3 representation dated 16.10.2015 has not been disposed of till now, before the concerned Land Acquisition Officer within a period of four weeks from today. Further, Land Acquisition Officer, Patna (Respondent No.3) is directed to consider the fresh representation filed by the petitioner or representation dated 16.10.2015 (Annexure-1) in case the same has not been disposed of till now and dispose of the same after perusing the documents filed on behalf of the petitioner and pass reasoned and speaking order in accordance with law within a period of two months from the date of receipt/production of a copy of this order.

6. With the aforesaid observation/direction, the present writ application stands disposed of.
