Petitioners seek bail in a case registered for the offences punishable under Sections 341, 323, 324 and 302/34 of the Indian Penal Code.

Petitioners are in custody since 06.02.2018.

Submission is that allegation of commission of assault is general and omnibus. Similarly situated some other accused have been allowed bail by a Co-Ordinate Bench of this Court in Cr. Misc. No. 58527 of 2018 and by this Court in Cr. Misc. No. 47906 of 2018. There is case and counter case. Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties

Patna High Court CR. MISC. No.9911 of 2019(3) dt.02-05-2019 2/2 of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dulhin Bazar Police Station Case No. 30 of 2018, with the following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners. (Birendra Kumar, J) Rajan/- U T
