The petitioner has preferred this application for grant of regular bail in a case registered under sections 304B, 201 and and 34 of the Indian Penal Code.
As per the prosecution case, the accused persons are stated to have killed the daughter of the informant for non fulfillment of demand of dowry.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case only for the reason of his relationship being the husband of the deceased. The deceased was suffering from various ailments and died as a result of heart attack. Not finding it to be suspicious, cremation was performed. The petitioner has
Patna High Court CR. MISC. No.18967 of 2021(3) dt.21-10-2021 2/2 remained in custody since 1.6.2018 The earlier application for bail of the petitioner was rejected vide order dated 7.12.20218 passed in Cr.Misc. No. 65903 of 2018.
The application for bail is opposed by learned APP for the State who submits that the petitioner is the husband of the deceased and as per the report received from the learned trial court, five witnesses have been examined on behalf of the prosecution out of the total 10 chargesheet witnesses. Having heard learned counsel for the parties and taking into consideration the allegations together with the progress in the trial in the learned trial court, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
