The petitioner apprehends his arrest in a case registered for the offence under Section 7 of the Essential Commodities Act.

As per the prosecution case, this petitioner along with other F.I.R. named accused persons used to supply diesel and cooking gas cylinders for the purpose of running the boats. It is submitted on behalf of petitioner that only on suspicion, petitioner has been made accused in this case by the local Dafadar. Nothing has been recovered from the conscious possession of this petitioner. No offence is made out under the Essential Commodities Act. Similarly situated co-accused has been granted bail by this Court vide order dated 13.04.2023 passed in Cr. Misc. No. 4464 of 2023.

Patna High Court CR. MISC. No.9894 of 2023(2) dt.25-04-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bhojpur, Ara in connection with Barhara P.S. Case No. 634 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
