Statement of victim has been recorded under section 164 of the Cr.P.C in which she made accusation of kidnapping against the petitioner and some others. The victim was found major by the learned Magistrate who recorded statement of the victim. The contention on behalf of the petitioner is that informant has admitted in his written report that one Kusho Devi had seen the victim going along with other boy.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Korha P.S. Case no. 57/2015.
