Petitioner, Pradeep Sah @ Pradeep Kumar Sah, seeks bail in Purnea Sadar P.S. Case No.319 of 2014, registered for the offences punishable under Section 393 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot and nothing has been recovered from the possession of the petitioner. The name of the petitioner figured in the case only in the confessional statement of two accused persons apprehended on the spot. The petitioner was arrested on 06.07.2014 but he was not put on test identification parade.

Considering the fact that the petitioner, Pradeep Sah @ Pradeep Kumar Sah, was not apprehended on the spot and even after being arrested, he was not put on test identification parade

Patna High Court Cr.Misc. No.42363 of 2014 (3) dt.16-02-2015 2/2 although he is in jail since 06.07.2014. he is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in Purnea Sadar P.S. Case No.319 of 2014.
