The petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 454 of 2018 instituted for the offence under Section 30(A) of the Bihar Excise Prohibition Amendment Act, 2016. After some arguments, Mr. Mushtaq, learned advocate for the petitioner seeks permission to withdraw this petition in order to enable the petitioner to surrender before the court below and seek bail.

Should such an application be filed on behalf of the petitioner, the court below shall take into account that the recovery of 15 liters of local spirit is from a joint house and that the petitioner has clean antecedents and shall pass orders in accordance with law without being
