JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Supaul P.S. Case No.248 of 2010, disclosing offences under Sections 302, 307, 147, 148, 149, 341, 342, 323, 434 and 227 of the Indian Penal Code.

Learned counsel, appearing on behalf of the petitioner, submits that the petitioner has been made accused in connection with a case of murder of one

Patna High Court Cr.Misc. No.46074 of 2015 (2) dt.13-10-2015 2/2 Bhupendra Yadav. He submits that prior to institution of the present Supaul P.S. Case No.248 of 2010, Supaul P.S. Case No.247 of 2010 was instituted on the basis of which, it is discernible that the said Bhupendra Yadav was assaulted by the villagers, while he was attempting to commit Dacoity. He further submits that so far petitioner's involvement in the present case is concerned; there is no eye-witness. In any event, he submits that there is no specific allegation against this petitioner.

In view of the submission, as noted above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S. Case No.248 of 2010.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
