JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-11-2019 The present writ petition has been filed for directing the respondents to take appropriate steps for removing the encroachment made by the private respondents over land bearing Mauza-Kahua, Thana No. 269, Old Khesra No. 278, Khesra No. 666, admeasuring 12 decimals, Khesra No. 1318, admeasuing 09 decimals, Circle-Biroul, P.S. Biroul, DistrictDarbhanga. This Court is of the opinion that in case the

Patna High Court CWJC No.15296 of 2017(3) dt.21-11-2019 2/2 petitioner is aggrieved by illegal encroachment having been made by the private respondents, he is required to approach the Circle Officer concerned who is the Circle Officer-Biroul, District-Darbhanga.

Accordingly, liberty is granted to the petitioner to file appropriate complaint under the provisions of the Bihar Public Land Encroachment Act, 1956 before the said Circle OfficerBiroul, District-Darbhanga whereupon the said Circle Officer shall take appropriate action in accordance with the Act, 1956 for removal of the illegal encroachment made over the public land.

The writ petition stands disposed off on the aforesaid terms.
