2. The petitioner apprehends his arrest for the offences alleged under Sections 379, 411 of the Indian Penal Code and Sections 4, 6, 8 of B.M.P.I.T.S. Storage Rule, 2003 registered in connection with Dhoraiya P.S. Case No. 20 of 2019.

3. It is submitted that the petitioner has been falsely implicated in connection with recovery of stolen coal from the trailor. It is submitted that the seized vehicle was plying on hire and the coal has been brought by M/s Taj Bricks. In any event the petitioner has deposited the amount of loss in the office of District Mines Officer, Banka.

4. Having regard to the nature of accusations and the gravity of the offence alleged, this Court is not inclined to grant

Patna High Court CR. MISC. No.6066 of 2020(2) dt.02-03-2020 2/2 the privilege of anticipatory bail to the petitioner. The petition stands dismissed.

5. If the petitioner surrenders and seeks regular bail before the learned Court below the same shall be considered on its own merit in accordance with law, without being prejudiced by any observation in the present order.
