The petitioner, who is languishing in custody, seeks bail in a case registered under Section 394 of the Indian Penal Code, is one of the named accused in this case with allegation of successful escape after committing the crime of road dacoity.
Submission is of false implication on the behest of police only because of his alleged implication in six more cases, such as:- (i) Pirpainty P.S. Case No. 17 of 2010, (ii) Pirpainty P.S. Case No. 178 of 2011, (iii) Pirpainty P.S. Case No. 219 of 2011, (iv) Pirpainty P.S. Case No. 189 of 2011, (v) Pirpainty P.S. Case No. 239 of 2011 and (vi) Pirpainty P.S. Case No. 15 of 2012 and in all the cases aforementioned the petitioner is on bail. Further, in spite of being in custody right from 1st June, 2014 neither Test Identification Parade is conducted nor anything has been recovered from the possession or alleged disclosure.
If it is so, having regard to the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of
Patna High Court Cr.Misc. No.42713 of 2014 (3) dt.21-01-2015 2/2 the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bhagalpur, in connection with Pirpainty P.S. Case No. 128 of 2014, subject to condition to remain physically present before the court below on each and every date till disposal of the case and in case of failure on two consecutive dates without giving any reasonable explanation, the privilege granted shall be deemed to be cancelled.
