====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-11-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Warisnagar P.S. Case No. 129 of 2015 registered under Sections 363, 366(A), 323 and 504/34 of the Indian Penal Code. The accusation is that Gunjan Kumari, daughter of the informant, and Asha Kumari, daughter of Ram Udar Singh, had gone to the house of petitioner no. 1 but they did not returned. Thereafter, informant and Ram Udar Singh went there and came to know that their daughters have been enticed away by the petitioner no.1 and his family members.

Learned counsel for the petitioner submits that victim,

No.48433 of 2015 (2) dt.09-11-2015 Asha Kumari, moved from her house for Delhi according to her sweet will and she stayed at the house of her sister and thereafter she performed the marriage with Suraj Kumar and started to live with him at Delhi and Allahabad and she also disclosed that another girl Gunjan, daughter of the informant, was married to Raja and she was also residing at Chhitrakut along with her husband, which has came in the statement of Asha Kumari as recorded under Section 164 of the Cr.P.C. It is further submitted that petitioners have falsely been implicated in this case with ulterior motive. It is further submitted that petitioners have no criminal antecedent and are in custody since 08.07.2015.

Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Samastipur, in connection with Warisnagar P.S. Case No. 129 of 2015.
