Mr.Lalan Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-04-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302/201 and other ancillary sections of the Indian Penal Code. It is a case of triple murder in which suspicion has been raised against the petitioner and other accused persons. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and the parties are agnate and laid dispute is going on between them. Informant is not the eye witness of the occurrence. No other substantive evidence has been collected during course of investigation to suggest the implication of this petitioner in the present case. He submits that when wife of the petitioner asked the informant side to compromise the earlier

Patna High Court CR. MISC. No.8682 of 2022(2) dt.11-04-2022 2/2 case, petitioner has falsely been implicated in this case. Petitioner is in custody since 24.4.2020. Similarly situated coaccused have already been allowed bail by a co-ordinate bench of this Court vide para 14 of the bail petition. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge V, Motihari, East Champaran in Sessions Trial No. 302 of 2021.
