JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is named in the FIR but no specific overt act has been attributed against him nor the informant claimed himself to be the eye witness of the occurrence. Learned counsel for the petitioner points out that one co-accused, namely, Jagarnath Choudhary, having similar allegation, has already been granted the privilege of bail by a coordinate Bench of this Court vide order dated 19.1.2015 passed in Cr. Misc. No. 34836/2014.

Considering the aforesaid submission as well as in the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.45896 of 2015 (2) dt.30-09-2015 2/2 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kawakole P.S. Case No. 57 of 2014 to the satisfaction of the Sri S.K. Mishra, Judicial Magistrate, 1st Class, Nawada.
