The petitioner seeks bail in a criminal prosecution registered under Sections 372/376 and some other allied offences of the Indian Penal Code.
Taking into consideration the fact that the petitioner is alleged to have sold his own wife Sunita Kumari to one Jhoti Sah after taking money of Rs.50,000/- from him, this Court is not inclined to accede to the prayer made on behalf of the petitioner at this stage. Accordingly, his prayer for bail in connection with Motihari Muffasil P.S. Case No.169 of 2014, pending in the court of the learned Chief Judicial Magistrate, East Champaran at Motihari, is rejected for the present.
The learned C.J.M., East Champaran at Motihari is directed to commit the case of the petitioner to the court of Sessions, if not already committed, forthwith since the petitioner is stated to be in judicial custody since 29.06.2014. On such commitment, the trial of the petitioner shall be taken up on priority
Patna High Court Cr.Misc. No.42583 of 2014 (3) dt.21-01-2015 basis by the learned trial court. If the trial is not concluded within a period of nine months from the date of such commitment, then the petitioner shall be at liberty to renew his prayer for bail. (Birendra Prasad Verma, J) Arvind/- U T
