JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

It has been alleged by the informant, a police official against the petitioner to have in possession of countrymade loaded pistol, which was seized on search.

It has been submitted on behalf of petitioner that police had wrongly and illegally apprehended the petitioner in order to cover-up their own lapses identified the petitioner to be one of the members of a gang, who was engaged in looting of a businessman namely Ankit Khetan. To justify the same, the learned counsel for the petitioner drew attention towards Column-2 of the search-cum-seizure list wherein name of the petitioners has been inserted subsequently and the same is apparent on bare perusal. On the other hand, learned Additional Public

Patna High Court Cr.Misc. No.48720 of 2015 (02) dt.03-11-2015 Prosecutor opposed the prayer and submitted that from Para-3 of the petition, it is evident that petitioner has also been involved in a dacoity case.

Considering the facts and circumstances of the case, petitioner, Sujeet Kumar Sah is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Tilkamanjhi (Kotwali) P.
