JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-04-2017 Braj Mohan Thakur Law College, Purnia through its Secretary is the petitioner, which is privately managed college having affiliation with B.N.Mandal University, Madhepura. The College receives grant-in-aid from the State Government for payment of salary to the teaching and non-teaching employees. It is the grievance of the petitioner that though the State government released a sum of Rs. 18, 99, 600/- for payment to the teaching and non-teaching employees of the College for the academic Sessions 2006-2009, the University has not released the said amount to the College for payment.
Patna High Court CWJC No.13339 of 2016 (3) dt.17-04-2017 2/2 A counter-affidavit has been filed on behalf of the University from which it appears that the University has released a sum of Rs. 11,55,200/- to the College out of the total amount released by the State government for the College in question. There is nothing on record which can be said to be plausible reason for non-release of the total amount by the University to the College, which is said to have been made available by the State Government to the University. In the facts and circumstances of the case, I dispose of the writ application with a direction that if the University receives from the College details of the amount which could not be paid to the employees of the College because of non-release of the rest of the amount by the University, the University shall look into it and release rest of the amount within a period of two months from the date of submission of the factual details by the College. This application stands disposed of.
