====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-02-2020 Petitioner seeks regular bail in connection with Baikunthpur P.S. Case No. 319 of 2019 registered for the offence punishable under Section 25(1-b)a, 26(1), 35 of the Arms Act.

Allegation as per F.I.R. is that one loaded country made Katta with one live cartridges was recovered from the possession of the petitioner no.1 and petitioner no.1 is accused in one another case and petitioner no.2 is accused in five cases. Submission of the learned counsel for the petitioner is that all the cases against petitioner no.2 are under Excise Act and moreover, both the petitioners are in custody since 10.12.2019.

Having heard both sides, in view of the facts and circumstances, at this stage I am not inclined to grant bail to the petitioners. However, petitioners would be at liberty to renew their prayer for bail once the charge is framed or after completion of six months in custody whichever is earlier.
