The petitioner apprehends his arrest in connection with Athmalgola P.S. Case No. 44 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act pending in the Court of Special Judge, Excise Act, Patna. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner is named in the first information report and there is direct allegation against him of being indulged in sell of illicit

Patna High Court CR. MISC. No.18522 of 2021(4) dt.25-10-2021 2/2 liquor. Hence, the petitioner does not deserve to be enlarged on anticipatory bail.

Having considered the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected. (Arvind Srivastava, J) shailendra/- U T
