JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Dihri Nagar P.S. Case No.198 of 2015, disclosing offences under Section 392 of the Indian Penal Code. The petitioner is in custody since 14.05.2015. As per the prosecution case, three unknown miscreants snatched the golden chain, which the informant's sister was wearing. One of the miscreants was overpowered

Patna High Court Cr.Misc. No.46649 of 2015 (2) dt.16-10-2015 2/3 by local people, who disclosed his name to be Sadeek Ansari, the petitioner.

Learned counsel, appearing on behalf of the petitioner, referring to the First Information Report, has submitted that the sister of the deceased, whose golden chain is said to have been snatched, has not identified the petitioner as the person responsible for the offence. He further submits that charge-sheet has already been submitted and no purpose would be served, if the petitioner is compelled to remain in jail any further. It has been stated in Paragrph-3 of the application that petitioner has got no criminal antecedent.

In view of the submission as above, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Dehri, Rohtas, in connection with Dehri Nagar P.S. Case No.198 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court,

Patna High Court Cr.Misc. No.46649 of 2015 (2) dt.16-10-2015 3/3 on two consecutive occasions, his bail bond shall be liable to be cancelled.
