2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 120(b), 302/34 of the Indian Penal Code.
3. According to F.I.R., all the named accused persons inappropriately operated upon pregnant wife of the informant as a result of which she died in the hospital during the operation.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name transpired during course of investigation. It is not the case of informant that this petitioner operated or treated his wife. Only material that has come in the case diary is that petitioner is owner/manager of the hospital in question. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the fact that petitioner is not named in the F.I.R. and he did not operate the wife of informant, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P. S. Case No. 373 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
