The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a, 26 of the Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 28.10.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of one country-made loaded pistol along with one live cartridge.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. Nothing was recovered from his possession and even assuming

Patna High Court CR. MISC. No.8764 of 2022(2) dt.16-06-2022 2/2 what has been alleged is true without admitting for the purposes of bail and the thrust of the allegation is under the Arms Act. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Siwan (Town) P. S. Case No.588 of 2021, subject to the condition that one of the bailors shall be the father of the petitioner namely, Md. Nasim. The application stands allowed.
