The petitioner seeks bail in anticipation of his arrest in connection with Kathaiya P.S. Case No. 202 of 2019 dated 25.12.2019 instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2018.
308 litres of raw spirit and 530.985 litres of liquor is said to have been recovered from the house of one Chintu Rai. The petitioner is stated to be one of the associates of Chintu Rai and is also alleged to be trading in liquor.
The petitioner denies such allegation and
Patna High Court CR. MISC. No.7720 of 2020(2) dt.10-06-2020 2/2 submits that no case in the past has been registered against him. He has falsely been implicated in this case. Considering the aforenoted facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur in connection with Kathaiya P.S. Case No. 202 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
