JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Raxaul P.S. Case No.85 of 2015, disclosing offences under Sections 341, 323, 324, 325, 307 and 379/34 of the Indian Penal Code.

Learned counsel, appearing on behalf of the petitioners, submits that the present case is counter blast of another case instituted by the petitioners' side on the same date, giving rise to Raxaul P.S. Case No.86 of 2015,

Patna High Court Cr.Misc. No.46597 of 2015 (2) dt.14-10-2015 2/2 in which police after investigation have submitted chargesheet against the informant and others under Sections 447, 323 and 379/34 of the Indian Penal Code. He submits that the petitioners are in custody since 20.08.2015. He further contends that the injuries found on the informant have been found to be either simple or on non-vital parts of the body.

In view of the submission as above, this application is allowed. The petitioners, abovenamed, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul, East Champaran, in connection with Raxaul P.S. Case No.85 of 2015.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required, and in the event of failure on their part to appear before the Court, on two consecutive occasions, their bail bond shall be liable to be cancelled.
