Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is languishing in custody since 23.05.2018 in connection with Fenhara P.S. Case No.21 of 2018 registered for the offences punishable under Sections 379, 411, 412, 413, 414, 420, 455, 467, 468/34 of the Indian Penal Code.

Prosecution case as per the FIR is that the informant apprehended co-accused Mahurendra Singh@Madhu Singh with stolen motorcycle who disclosed that the alleged stolen motorcycle was given to him by this petitioner. It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.7977 of 2019(2) dt.13-02-2019 2/2 that the stolen motorcycle has been recovered from the apprehended co-accused Mahurendra Singh and the petitioner has falsely been roped in this case only on the basis of the statement of the apprehended co-accused. It is further submitted that investigation has already been concluded and the petitioner is accused in four other cases in which he is on bail in all the cases.

Learned A.P.P. has vehemently opposed the prayer for bail and submits that the name of the petitioner sprang up on confession of the apprehended co-accused.

Considering the fact that stolen motorcycle was recovered from the co-accused and the investigation has been concluded, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-12, East Champaran (Motihari) in connection with Fenhara P.S. Case No.21 of 2018.
