The present petition has been preferred for quashing of the order dated 21.05.2015 passed by the learned A.D.J.-II, Jamui, in Session Trial No. 439 of 2013 (arising out of Jamui P.S. Case No. 95 of 2013) whereby the discharge petition filed under Section 227 Cr.P.C. dated 24.09.2013 was rejected. As per the prosecution story, the informant alleged that his brother had gone to temple to worship but did not return. Later, he got a call by unknown person stating that his brother is captive with them. Thereafter, the phone was disconnected. Accordingly, the F.I.R.
The police submitted charge-sheet followed by
Patna High Court CR. MISC. No.49286 of 2015(2) dt.17-03-2023 2/2 cognizance and thereafter, the discharge petition was preferred which came to be rejected on 21.05.2015 by a reasoned order by the Court of Additional Sessions Judge-II, Jamui. No case for interference is required.
The petition stands dismissed.
