Heard learned A.P.P for the State, through video conferencing.

The petitioner has filed the instant application for grant of regular bail in connection with Dumaria P.S. Case no. 14 of 2014 registered for offence under sections 436, 435, 147, 148, 149 and 120B of the Indian Penal Code, sections 3 and 4 of the Explosives Substance Act and section 17 of the CLA Act. As per allegation in the F.I.R., it is stated that in the night the extremists belonging to MCC carried out a bomb blast destroying the tower of Airtel Company. It is stated that on enquiry from the local population, the names of 50 persons including the petitioner herein transpired as belonging to the MCC besides 50 unknown.

No.7169 of 2020(5) dt.04-06-2020 2/2 It is submitted by learned counsel for the petitioner that except for his name having transpired as one of the 50 named persons about whom the informant came to know through the local persons, there is absolutely no material to connect him with the alleged offence. The petitioner is in custody since 28.2.2018 and a number of similarly situated co-accused have been enlarged on bail, one of the order having been brought on record as Annexure-2 to the petition.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and in the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Dumariya P.S. Case no.14 of 2014 on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya.
