Mr.Dashrath Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 08-05-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Aurangabad P.S. Case no. 177 of 2018, registered under Sections 323, 504 and 420/34 of the Indian Penal Code.

The accusation is that both the petitioners took cash of Rs. 2,80,000/- to sell the half katha of land from the informant, but in spite of much approach, the petitioners did not execute the sale deed and lastly when the complainant asked to execute the sale deed then both the petitioners abuse

Patna High Court CR. MISC. No.8955 of 2019(3) dt.08-05-2019 2/2 and assaulted him.

Learned counsel for the petitioners submits that while allegation has been made against the petitioners that they took cash of Rs. 2,80,000/- to sell half katha of land, but not a single cheat of paper has been shown by the complainant about receiving of the aforesaid money. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Complaint Case No. 177 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
