1. Heard the parties.

2. The petitioners apprehend their arrest in connection with Hasan Bazar P.S. Case No. 25 of 2024 dated 08.12.2024 registered under Sections 115(2), 127(1), 109, 303 (2), 351(2), 3(5) of the Bhartiya Nyay Sanhita.

3. As per the first information report on 06.12.2024 in the morning at about 9:00 A.M. while the informant was standing near Kali Sthan, the petitioners and other surrounded him, started assaulting the informant on his head and also snatched

Learned counsel for the petitioners submits that both the parties are co-villagers and there is dispute on the ground that buffalo of the petitioners entered into the field of the informant and started grazing. A counter case has been filed by the petitioner no. 1 bearing SC/ST (Ara) P.S. Case No. 60 of 2024. The side of petitioners have also sustained injury. Referring to the injury report at Annexure : P-2, learned counsel submits that injury sustained by the informant is simple in nature. The petitioners are having no criminal antecedent.

5. Regard being had to the submission made by the parties, taking into consideration the fact that both the parties are co-villagers, there is case and counter case and injury caused to the informant is simple in nature, as such, I am inclined to grant anticipatory bail to the petitioners.

6. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-8th, Ara (Bhojpur) in connection with Hasan Bazar P.S. Case No. 25 of 2024
