The petitioner apprehends his arrest in Excise case No. 8/2013 registered under Section 47(a) of the Bihar Excise Act.

The complainant, Assistant Commissioner, Excise, Rohtas got information about the fact that petitioner was indulged in trade of illicit liquor and on such half constructed house of the petitioner was raided and 1680 liters of spirit meant for manufacturing liquor was recovered. The motor cycle of the petitioner was also seized.

The learned counsel for the petitioner submits that petitioner has no manner of concern with the abandoned house and he has falsely been implicated in the case but it appears that

Patna High Court Cr.Misc. No.7732 of 2019(2) dt.13-02-2019 2/2 the case is of the year 2013. The half constructed house of the petitioner was searched and huge quantity of spirit was recovered from there. The motor cycle of the petitioner was also seized.

Considering the facts aforesaid and nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
