JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor, appearing on behalf of the State. This is an application for grant of regular bail on behalf of the petitioner who is an accused in Kalyanpur P.S. Case No. 01 of 2015 for the alleged offences under Sections 363,365,366/34 of the Indian Penal Code and Section 3(i) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. Considering the submissions made on behalf of the petitioner, with reference to the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure, this application is allowed.

Let the petitioner above named be released on bail on

Patna High Court Cr.Misc. No.45976 of 2015 (2) dt.06-10-2015 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in Kalyanpur P.S. Case No. 01 of 2015.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
