2. The petitioner seeks regular bail in connection with Ekma P.S. Case No. 401 of 2023 registered on 25.09.2023 under Sections 392 of the I.P.C.

3. As per the prosecution case, F.I.R. has been lodged against three unknown accused persons with allegation that they were involved in robbery.

4. Counsel further submits that petitioner is innocent and has committed no offence. Counsel for the petitioner submits that name of the petitioner has been figured in this case by the virtue of confessional statement of the co-accused. He further submits that petitioner is in custody since 10.10.2023 having one criminal case pending against him, in which he is on

Patna High Court CR. MISC. No.9848 of 2024(3) dt.16-04-2024 2/2 bail. He further submits that motorcycle which was subject to loot has not been recovered from the possession of the petitioner. He further submits that the sections in which case has been lodged are triable by Magistrate.

5. Learned counsel for the State opposes the prayer for bail.

6. Upon specific query made by this Court that whether charge has been framed or not, counsel for the petitioner submits that he is not aware of this fact that charge has been framed or not.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail two months after framing of charge and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Chapra in connection with Ekma P.S. Case No. 401 of 2023 subject to the conditions laid down under Section 437 (3) of the Cr.P.C.
