This application for grant of regular bail arises out of Sherghatty (Dobhi) P.S. Case No. 207 of 2014, disclosing offences under Sections 302 and 392/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned Senior Counsel appearing on behalf of the petitioner submits that confessional statement made by one Gopal Yadav before the Police is the sole basis for his implication in the present case. He submits that the petitioner is in custody since 04.08.2014 and the said Gopal Yadav has been granted bail by this Court vide order dated 13.07.2015 in Criminal Miscellaneous No. 23359 of 2015. He has further submitted that the petitioner has
Patna High Court Cr.Misc. No.46062 of 2015 (3) dt.01-12-2015 2/2 been falsely implicated by the Police since he has been made accused in several other cases. He has also submitted that other co-accused persons, whose names surfaced on the basis of confessional statement made before the Police, have been granted regular bail by this Court.
Considering the aforementioned submission, this application is allowed.
Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sherghatty, District-Gaya in connection with Sherghatty (Dobhi) P.S. Case No. 207 of 2014, if he is not required in any other case.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
