The petitioners, four in number, seek bail in a case under Section 302 and other sections of the Indian Penal Code. The deceased Reghunath Rai @ Nanhak Rai had love affair with the daughter of Nawad Rai. The deceased had fled away with the victim. A Panchayati was held and it was resolved that the deceased would leave the village. On the next date his dead body was found hanging from a tree. The informant suspected that petitioners and others might have killed Raghunath Rai @ Nanhak Rai.

It is submitted that there is no eye witness of the

Patna High Court Cr.Misc. No.45563 of 2015 (2) dt.30-09-2015 2/2 occurrence. Similarly situated accused Mahesh Rai has already been granted bail vide order passed in Cr. Misc. No. 3501/2015. Nawad Rai, father of the victim girl, has also been granted bail vide order passed in Cr. Misc. No. 26425/2015 and the case of the petitioners stand on the same footing.

Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sheohar in Tariyani P.S.
