JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-06-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Spl. Case No.1364 of 2019 arising out of Jokihat (Mahalgaon) P.S. Case No. 365 of 2019 for offences under Sections 323, 341, 504, 506 and 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioners submits that the petitioners, who are ladies, have no criminal antecedent and in the instant case total 10 litres of country made liquor was seized. It is further submitted that nothing has been recovered from conscious possession of these petitioners.

Let petitioners, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of 2nd Additional District and Sessions -cum-Special Judge, Araria in connection with Spl. Case No.1364 of 2019 arising out of Jokihat (Mahalgaon) P.S. Case No. 365 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
