The petitioner seeks bail in anticipation of his arrest in connection with Garkha P.S. Case No. 300/2018 dated 12.07.2018 (Complaint Case No. 828/2018) instituted for the offence under Section 420/406 of the Indian Penal Code.

The petitioner is alleged to have accepted Rs. 1,00,000/- from the informant/complainant for providing job to him in a Colliery. Neither job was provided to the informant/complainant nor money has been returned. Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.8827 of 2019(2) dt.14-02-2019 2/3 an absolutely false allegation has been levelled against the petitioner by the informant with whom he has civil litigation. The money is said to have been given to the petitioner about two years before the date of lodging of the complaint/F.I.R. The F.I.R. is absolutely vague in as much as the mode of payment of money to the petitioner has also not been disclosed.

Regard being had to the vague nature of the allegation against the petitioner and background enmity, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 14, Saran at Chapra in connection with Garkha P.S. Case No. 300/2018 (Complaint Case No. 828/2018), subject to the conditions as laid down under Section 438(2)
