JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 06-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor, appearing on behalf of the State. This is an application for grant of regular bail on behalf of the petitioner who is an accused in Sadar P.S. Case No. 349 of 2015 for the alleged offences under Sections 25(1-B)a, 26II, 35 of the Arms Act and Section 17 of the Criminal Law Amendment Act.
The petitioner is in custody since 17.07.2015. Allegedly, on an information furnished by a person running mobile shop, the police conducted raid in the house of the petitioner's son Gautam Kumar from whose possession a cell phone was seized and from the bookshelf, certain literatures
Patna High Court Cr.Misc. No.45977 of 2015 (2) dt.06-10-2015 indicating involvement of the petitioner with the Left Extremists' Organizations. From under the pillow, a country made pistol was allegedly recovered.
Learned counsel for the petitioner submits that over and above these facts, there is no material against the petitioner for his implication in the case and that there is no recovery of any incriminating material from his possession.
In view of the submissions as above, this application is allowed.
Let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali, Hajipur in Sadar P.S. Case No. 349 of 2015.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
