Petitioner is in custody in connection with Excise (Complaint) Case No. 305 of 2019-20 corresponding to Excise Act Case No. 1271 of 2019 for the offence under section 30(a) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that petitioner nothing was recovered from the conscious possession of the petitioner.

In the instant case total 34.38 liters of liquor was seized.

The petitioner is in custody since 21.12.2019. Considering the fact that petitioner has no criminal

No.6310 of 2020(2) dt.03-02-2020 2/2 antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge,Excise Act, Madhepura, in connection with Excise (Complaint Case No. 305 of 2019-20 corresponding to Excise Act Case No. 1271 of 2019 subject to the condition that if the petitioner is found involved in such similar cases, the court below shall be at liberty to cancel the bail bonds of the petitioner.
