JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date: 15-05-2018 Heard learned counsel for the petitioner and the respondents.

Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has obtained leave for prosecuting 6 months course in connection with Ph.D degree programme. He submits that the petitioner after completing the same has joined, but the respondent Principal of the School created hindrance and as such the petitioner has to approach the Teachers Employment Committee, the Patna Municipal Corporation in its meeting dated 30.12.2017 has directed for accepting joining of the petitioner vide Annexure-11

Patna High Court CWJC No.8315 of 2018 dt.15-05-2018 2/2 dated 08.02.2018, yet the petitioner was not allowed to join the school in question.

Considering the aforesaid, the Town Secretary-cumauthorized Officer, Patna Municipal Corporation is hereby directed to see that the order dated 08.02.2018 is implemented in its letter and spirit. If the Principal of the school creates hindrance in allowing the petitioner to join the school, despite order passed by the Secretarycum-authorized Officer, Patna Municipal Corporation dated 08.02.2018, liberty shall be available to the Secretary-cum-authorized Officer, Patna Municipal Corporation to take all coercive steps against the Principal of the school in question including stoppage of salary of the Principal and also to initiate the disciplinary action to ensure compliance of the direction of the Secretary-cum-authorized Officer, Patna Municipal Corporation.

In the event, joining of the petitioner is accepted, the respondents are required to work out the entitlement of the petitioner for grant of salary arrears and current within a period of 60 days from the date of receipt/production of a copy of this order.
