The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409, 420 of the Indian Penal Code.
Allegation against this petitioner is that at the time of payment of amount to the agency which has supplied low category of items in newly residential school in Tharuhat area petitioner had given consent on the report of Assistant and he had not given suggestion on the record for comparing the quality of materials.
It is submitted that on 28.03.2018 a meeting of District level Purchase Committee was held under the
Patna High Court CR. MISC. No.10283 of 2023(2) dt.12-05-2023 2/2 Chairmanship of Deputy Development Officer, Bettiah in which three Head Master of different schools and other District Level Officers were present and the relevant items of supply details were approved. It is further submitted that at the relevant time petitioner was posted as Head Clerk in the Office of District Welfare Office at Bettiah District. Petitioner was not the Member of Purchase Committee. Similarly situated co-accused have been granted bail by this Court. Petitioner claims clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Bagaha, West Champaran in connection with Bagaha P.S. Case No. 479 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
