JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 This is an application for grant of anticipatory bail in connection with Bhabua (Sonhan) P.S. Case No. 763 of 2018, disclosing offences under Sections 341, 323, 504, 307, 34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the informant and also allegation of assault against petitioner no.2 to Poonam Kumari.

Submission of learned counsel for the petitioners is that the allegation of assault to the informant is general and omnibus and specific allegation of assault against petitioner no.2 to Poonam Kumar by lathi causing simple injury, which will appear from Annexure-2. Further submission is that the petitioner no.2 is aged about 70 years and both petitioners have

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua, in connection with Bhabua (Sonhan) P.S. Case No. 763 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
