This writ petition has been filed for provisional release of the vehicle of the petitioner which stands seized in Confiscation Case No. 149 of 2016 arising from Forest Case No. 66 of 2016 bearing Registration No. JH02P/3121.
Mr. Uma Shankar Singh learned counsel for the petitioner submits that although an application for provisional release has been filed before the Forest Officer- cum- Divisional Forest Officer, Rohtas at Sasaram on 14.7.2016 but the same has remained pending.
Having heard learned counsel for the parties and
Patna High Court CWJC No.12090 of 2016 (2) dt.12-08-2016 considering the nature of grievance raised, I deem it fit to dispose of the writ petition with the direction to the Authorised Officercum Divisional Forest Officer, Rohtas at Sasaram to consider the application of the petitioner for provisional release and dispose of the same in accordance with law taking note of the legal position settled on the issue, within four weeks from the date of receipt/production of a copy of this order.
The writ petition is disposed of.
