JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-02-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Majhaulia P.S. Case No. 382 of 2019 for offences under Sections 120B, 191, 195 and 197 of the Indian Penal Code and Sections 20, 22 and 23 of the Narcotic Drugs & Psychotropic Substances Act.

Learned counsel for the petitioners submits that the petitioners have no criminal antecedent.

Considering the nature of allegation and gravity of the offence, this Court is not inclined to grant bail to the petitioners. The application is rejected.

No.6917 of 2020(2) dt.28-02-2020 2/2 However, in the event the petitioners surrender before the court below and seek regular bail, the court below shall consider and dispose of the same on its own merits on the same day without being prejudiced by the order of rejection of this application.
