JUSTICE RAKESH KUMAR ORAL ORDER 28-02-2018 Heard Shri Satish Kumar Agrawal, learned counsel for the petitioner and Shri Ranjeet Kumar Pandey, learned counsel appearing on behalf of opposite parties/ Bihar Kshetriya Gramin Bank.
The present petition has been filed with a prayer to restore CWJC No. 11333 of 2007, which stood dismissed on 01.08.2013 due to non prosecution.
At the very outset Shri Ranjeet Kumar Pandey , learned counsel for the opposite parties submits that the restoration petition has been filed much belatedly, however on going through the facts disclosed in the petition particularly statement made in paragraph nos. 3 and 4 of the petition, there is no reason to reject the restoration petition only on the ground of limitation.
In view of the facts and circumstances, the restoration

Let CWJC No. 11333 of 2007 be restored to its original file.
