Petitioner apprehends his arrest in connection with a case registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code.
Petitioner is the informant of the case who lodged FIR against accused persons as named in the FIR for killing his sister and hanging the dead body on the Sheesham Tree to show that it is case of suicide.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case on the basis of supervision report. Police has submitted chargesheet against 4 accused u/s 306 and 201 of IPC. Victim had love affair with someone which was not liked by her relatives and family
Patna High Court CR. MISC. No.6548 of 2020(4) dt.20-10-2020 2/2 members as such she committed suicide. FIR named accused Babulal Rai and Pappu Kumar have been granted regular bail by co-ordinate benches of this Court vide orders dated 27.11.2019 passed in Criminal Miscellaneous No. 55438 of 2019 and 20.01.2020 in Criminal Miscellaneous No. 388 of 2020, whereas co-accused Sonu Kumar has been granted anticipatory bail vide order dated 14.02.2020 in Criminal Miscellaneous No. 76593 of 2019. Petitioner has got no criminal antecedent. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on anticipatory bail in the event of his/her arrest or surrender before the court below within a period of four weeks from today upon furnishing bail bond of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned court below where the case is pending, in connection with Kathaiya P.S. Case No. 57 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
