The petitioners seek bail in anticipation of their arrest in connection with Kako (Bhelawar) P.S. Case No. 42 of 2020 instituted for the offences under Sections 147, 341, 323, 325, 307, 379, 504 and 506 of the Indian Penal Code.

No.21592 of 2021(2) dt.26-05-2022 2/3 It has been submitted on behalf of the petitioners that though they are said to have taken part in the assault but the injuries suffered by the victims have been opined to be simple in nature. It has further been submitted that an occurrence may have taken place at the time of deliberations regarding partitioning of the property amongst members of the extended family, but the accusation in the F.I.R. appears to be highly exaggerated. It has also been submitted that all the petitioners come from the same stock of family as that of the informant.

Regard being had to the facts afore-stated, the petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Addl. Chief Judicial Magistrate, Jehanabad in connection with Kako (Bhelawar) P.S. Case No. 42 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
