ANJANA MISHRA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioners and the learned counsel for the State.

The petitioners are in custody since 28.6.2014 in connection with Sahar P.S. Case No.85 of 2014 registered for the offences under Sections 147, 148, 149, 341, 323, 302/120B of the Indian Penal Code and Section 27 of the Arms Act, in which two persons were ambushed and shot down dead. It is submitted on behalf of the petitioners that there is deep-seated enmity between the petitioners and the informant as earlier the father of Sonu Singh and Kariman Singh, namely, Late Dadan Sharma, had been killed and it is on account of the

Patna High Court Cr.Misc. No.43875 of 2014 (5) dt.03-03-2015 2/2 said enmity, that the petitioners have now been named in the present F.I.R. as accused persons. So far as Prabhat Kumar alias Prabhat Singh alias Jhunki Singh is concerned, it is stated that he is close agnate of Sonu Kumar and Kariman Singh. A perusal of the case diary reveals that the allegation of firing is as against one Avinash and Golu Singh and not these petitioners.

Considering the materials available in the case diary and also the facts that the petitioners have been in custody since 28.6.2014 and have no criminal antecedents, let all the three petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara, in connection with Sahar P.S. Case No.85 of 2014.
