JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 22-01-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners apprehend their arrest in connection with Raniganj P.S. Case No. 401 of 2020, registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506, 34 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that for the same occurrence two cases have also been lodged on behalf of

Patna High Court CR. MISC. No.19515 of 2021(2) dt.22-01-2022 2/2 the petitioner's side. The petitioner's side has also been injured. He has also submitted that the allegation against the petitioner No. 1, Sunil Bahardar, is that he inflicted rod blow on the head of the informant and similarly the allegation against the petitioner No. 3, Shivanand Bahardar, is that he inflicted with dabiya on the head of Ramdeo Bahardar, but both these injured persons have sustained injuries which is simple in nature. There is no specific allegation of inflicting assault against petitioner No. 2 Umanand Bahardar.

Considering the above-mentioned facts and circumstances, let the petitioners be released on anticipatory bail in the event of their arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Raniganj P.S. Case No. 401 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
