The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 399 402, 413, 414, 420, 467, 468, 471, of the Indian Penal Code. It is a case for preparation of commission of offence by the petitioners along with co-accused persons, a raid was conducted and five persons were apprehended and on search, two daggers, one motorcycle and other articles were recovered from their possession.

Learned counsel for the petitioners submit that the petitioners are innocent and have committed no offence. They

Petitioners have no concern with the alleged recovery nor any stolen articles were recovered from their possession. It is further submitted that motorcycle in question registered in the name of father of the petitioner no-2. The petitioners are languishing in judicial custody since 27.11.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Bettiah Town P.S. Case No. 880 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, District-West Champaran.
