JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. 550 bags each containing 50 Kg grains were recovered from the house of the petitioner but submission on behalf of the petitioner is that the seized bags belong to one Jitendra Yadav, who happens to be tenant of the petitioner.

The contention on behalf of the petitioner is that earlier petitioner was granted privilege of anticipatory bail by a coordinate Bench of this Court, subject to condition that the above stated tenant Jitendra Yadav, will swear an affidavit in support of the aforesaid stand of the petitioner but the aforesaid tenant refused to swear an affidavit and thereafter, petitioner was arrested on 07.08.2015 and since then he is languishing in jail custody.

Patna High Court Cr.Misc. No.46452 of 2015 (2) dt.01-10-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Madhubani in connection with Ladaniya P.S.Case No. 02 of 2013.
